FARM CORR GLASSBOARD ALTERNATIVE® LIMITED LIFETIME WARRANTY OF 25 YEARS

  1. WARRANTY PERIOD: Smittys Only Son Enterprises LLC dba FARM CORR GLASSBOARD ALTERNATIVE (“FARM CORR”), at 30 N. Nashville Avenue in Orlando, Florida 32805 warrants to the Purchaser, and subsequent Owners, where applicable per Transferability Paragraph #12 below, that the Product will be free from manufacturing defects in material and workmanship for a Limited Lifetime Period of 25 years from the date of purchase, subject to the terms and conditions contained herein.
  2. DEFINITIONS: “Purchaser” is defined as the customer that purchased FARM CORR GLASSBOARD ALTERNATIVE plastic panels from a retailer and has an Original Paper proof-of-purchase receipt with the: a) Date of purchase; b) SKU of FARM CORR listed therein & c) Retailer Name, Address, City and State. “Original Paper Proof-of-Purchase Receipt” is defined as the Retailer’s Receipt that came out of the Register when customer checked out and paid for the FARM CORR Product. “FARM CORR GLASSBOARD ALTERNATIVE Plastic Panels” are defined as the FARM CORR 4 x 8’ (48” w by 96” l) White Polypropylene Plastic Panels that are each 3/8” or 10 mm in thickness, whereby the interior channels or “flutes” are running the 96” length.
  3. WARRANTY PROCEDURE: The Purchaser must contact FARM CORR GLASSBOARD ALTERNATIVE at farmcorr.warranty@gmail.com to report any claim under the Warranty within thirty (30) days on which the Purchaser discovers the defect which is the subject of the Purchaser’s claim. Emailed claim shall include: 1) Scan of Original Purchase Receipt; 2) Photo(s) of FARM CORR application or use by Customer; 3) Written description of Warranty Issue.
  4. WARRANTY CLAIM DEADLINE: Failure to report a written claim within 30 days may result, at company’s discretion, in the Purchaser’s claim being ineligible under this Limited Lifetime Warranty. FARM CORR reserves the right to request additional info from Customer to ascertain the eligibility of the Purchaser’s claim under this Warranty. Upon written request from FARM CORR to the Purchaser via email or certified letter, the Purchaser agrees to permit FARM CORR or its representatives to inspect the Product, at FARM CORR’s own expense, within 60 days of the date of the claim.
  5. EXCLUSIVE REMEDY: The Purchaser’s remedy and the liability of FARM CORR under this Warranty will be to replace the Product with a similar-sized Product, for pickup at the Original Retailer. FARM CORR shall not be liable or responsible for the cost of labor, cutting, shipping or any other incidental or consequential costs with the removal, cutting, delivery, or installation of the Product or the delivery, cutting and/or installation costs provided under this Warranty.
  6. EXCLUSIONS: This LIMITED LIFETIME WARRANTY does not apply to any failure, defect or damage to a Product resulting, in whole or in part, from (a) any misuse, abuse, neglect, negligence, accident, abnormal physical stress or abnormal environmental conditions; (b) any failure to install or use the Product in strict accordance with FARM CORR’s Copyrighted installation instructions that are on farmcorr.com, or the use of the Product with any third party product such as PVC Wallboard, that has not been approved in writing, in advance, by FARM CORR; c) any improper storage or use of the Product, for instance if the Product was stored outside. d) any failure to properly clean, via Electric Pressure Washing low-pressure, under 2,000 PSI the FARM CORR product daily or weekly; e) any act of God, including fire, vandalism, wind damage or damage from wind-blown objects, earthquake, flood, lightning, hurricane or tornado; (f) any defect in, failure of, or water damage or otherwise to the 2 x 4’ wood framing or supporting structure on which the Product is installed, including any structural defects or damage caused by movement, distortion, collapse, cracking  or settling of the wall, framing, decking,  ground, foundation or structure of the building in which the Product is installed; g) any long-term exposure of the Product to exterior conditions such as sunlight and other light, metal oxides or metallic particles, smoke, animal waste, chemicals, dirt, road salt, or j) alteration of the Product besides ordinary wear and tear.
  7. WEAR AND TEAR EXCLUSIONS: Wear and Tear caused by normal use of this Product shall be excluded from the Warranty. Normal wear and tear includes scratches, marks, abrasion marks in cleaning, holes by mounting screws and residue by seam bonding.
  8. CONSUMER PROTECTION LAW: For any Purchaser who is covered by applicable consumer protection laws or regulations in the Purchaser’s state of purchase or residence which, by law, cannot be disclaimed, the benefits to the Purchaser under this Warranty are in addition to other rights and remedies of the Purchaser under such laws or regulations. Any provision of this Warranty that conflicts with any such customer rights or benefits is not applicable to any Purchaser covered by such law or regulation, so the exclusions and limitations set out in this limited warranty may not apply, or may not fully apply, to the Purchaser.
  9. DISCLAIMERS: This 25 Year Limited Lifetime Warranty is expressly in lieu of any and all other obligations, guarantees and conditions, whether written or implied by Statute or Law, including fitness for a particular purpose. Some states do not allow limitations on how long an implied warranty or condition lasts, so the above limitation may not apply to the Purchaser. If applicable law specifies a minimum Warranty Period that is longer than this “FARM CORR Limited Lifetime Warranty of 25 Years,” then the Warranty Period for the FARM CORR Product will be adjusted to the minimum period so required.
  10. LIMITATION OF LIABILITY: To the maximum extent permitted by Law, in no event, under any cause of action or theory of liability, shall FARM CORR be liable to the Purchaser or any Third Party for any special, indirect, incidental, exemplary, punitive or consequential damages of any kind whatsoever, arising out of the use of the FARM CORR Product.
  11. SEVERABILITY: This Warranty may not be modified, altered or expanded by anyone, including any FARM CORR product distributors, retailers or sales reps.
  12. TRANSFERABILITY: This Warranty is transferable and assignable, provided the Purchaser provides their original, non-copied Purchase Receipt from the Retailer to new owner(s) of Product.
  13. ENTIRE AGREEMENT: This Limited Lifetime Warranty of 25 years constitutes the entire agreement between FARM CORR GLASSBOARD ALTERNATIVE® and the Purchaser pertaining to the Warranty for, and liability relating to, the Product and supersedes all other agreements, understandings, negotiations, representations and warranties, whether oral or written.
  14. GOVERNING LAW: This Warranty shall be governed by, and interpreted in accordance with, the laws of the State of Florida, including all Consumer Protection Laws in accordance with the Florida Offices of Attorney General.
